This public site sets no cookies, uses no trackers and makes no request to any
third-party server. The only data we receive is what you choose to send us through the contact form.
Version of 29 September 2026. This is a translation: the
French version prevails.
1Who processes your data
The data controller is LES TERRASSES DE POVAI 2026, a société par actions simplifiée with a share
capital of 200,000 XPF, being registered with the Papeete trade and companies register, whose registered office
is PK 5 côté Ouest et Mer, Domaine Boubée Barrier, Uturoa, Raiatea — BP 1628, 98735 Uturoa, French Polynesia,
represented by Mr Fabrice CONVERT, managing director.
The General Data Protection Regulation (GDPR) and the French Data Protection Act of 6 January 1978,
as amended, have applied in French Polynesia since 1 June 2019. The French data protection authority,
the CNIL, is the competent supervisory authority.
3What we receive
Nothing until you send the form. Simply browsing the pages involves no collection on our part: no
account, no profile, no audience measurement.
When you send the contact form, we receive by email:
your surname and first name;
your email address;
your telephone number, if you give it;
your country of residence, if you give it;
the type of residence you are interested in, if you specify it;
the message you write;
your IP address and the date of sending.
The IP address appears in the email we receive. It is used solely to establish where a message came from and
to filter out automated submissions; it is neither cross-referenced nor used to track you. The server also keeps
an encrypted fingerprint of your IP address, from which the address cannot be recovered, to space out
two successive submissions. It serves no purpose after thirty seconds and is erased automatically at the next
request to the server.
Please do not send us sensitive data through this form — health, beliefs, trade union membership: it is
not designed for that and we have no use for it.
4Why, and on what basis
Your data is used only to handle your enquiry: to reply to you, to send you the documentation you ask for,
and to continue the conversation if you wish.
The legal basis is your consent, given by ticking the box before sending, and, as the exchange continues,
pre-contractual steps taken at your request.
Your data is never transferred, rented or sold, and is never used for marketing on behalf of anyone
else.
5Who has access
The publishing company, to answer your enquiry.
GANDI SAS, host of the site and of the mailbox, as technical processor, for the delivery and storage
of email. Servers located in France.
The programme’s notary and, where applicable, the distributor you have designated, only if your
enquiry leads to a reservation — and then solely for the reservation agreement and the deed of sale.
Google, whose Gmail service the company uses to read and answer the messages received at
contact@lesterrassesdepovai.com: these messages are copied there.
Transfer outside the European Union. Because of this mailbox, your message may be processed by Google LLC
in the United States. This transfer relies on the EU–US Data Privacy Framework, to which Google LLC has
certified, and otherwise on the European Commission’s standard contractual clauses. No other transfer outside the
European Union takes place. French Polynesia, where the company is based, has been under the same data protection
regime as metropolitan France since 1 June 2019.
6How long
Enquiry with no follow-up — the message is kept for three years from our last contact with you,
then deleted.
Enquiry leading to a reservation — the necessary data is carried over to the contractual file and kept
for the duration of the relationship, then for the limitation and retention periods applicable to the sale
documents.
Anti-flood technical fingerprint — an encrypted fingerprint of your IP address, useless after thirty
seconds and erased at the next request to the server.
You may ask for deletion at any time, without waiting for these periods to end.
7Cookies and trackers
This site sets no cookies and uses no trackers. No audience measurement, no advertising, no social media
buttons, no pixels.
Fonts are hosted on our own servers: your browser contacts no outside service during your visit, and your
IP address is not passed on to anyone merely because you view the site.
That is why no consent banner is shown to you: there is nothing to consent to.
8Security
The site is served over HTTPS; form data travels encrypted. The message is handed to the mail server over
an authenticated, encrypted connection (STARTTLS).
The public form feeds no database: your enquiry is sent by email and is not stored on the site’s
server.
9Your rights
You have the right of access, rectification, erasure, restriction,
objection and portability regarding your data, and the right to withdraw your consent at any
time — withdrawal does not affect what was done before. You may also give instructions on what should happen to
your data after your death.
To exercise them, write to
contact@lesterrassesdepovai.com or to
LES TERRASSES DE POVAI 2026, BP 1628, 98735 Uturoa, French Polynesia. We reply within one month. We may ask
for proof of identity if there is reasonable doubt about who you are.
If you are not satisfied with our reply, you may lodge a complaint with the CNIL:
3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France, or at
www.cnil.fr.
10Partner area
The partner area, reached from this site, is reserved for the professionals who
distribute the programme — estate agencies, business introducers — and for those applying for access. The data
controller is the same: LES TERRASSES DE POVAI 2026.
What is processed — the identity and contact details of the people representing the partner company,
the documents in its file (company registration extract, Tahiti number, insurance certificate, professional
card, identity document of the manager), signed documents, and the time-stamped log of its actions on the
platform.
Why, and on what basis — to review the application, then to perform the signed mandate or agreement
and keep evidence of it.
How long — the documents of an application that is not accepted are deleted one year after the
decision; those of a relationship that has ended, five years after its end. Signed documents follow the
limitation periods. IP addresses in the log are masked after one year.
Hosting — the platform and its database are hosted by GANDI SAS, in France.
Cookies in the partner area. A strictly necessary session cookie is set as soon as a page of the
area is opened (including the login page): it carries the login and form protection, is not used for any
audience measurement, and disappears when the browser is closed. When a client opens the viewing access
sent to them, a second cookie of the same kind keeps proof of their code for the duration of that access —
72 hours at most. Neither is set when simply visiting the public site. The area’s fonts, like the site’s, are
hosted by us.
11Prospects introduced by a professional
If a professional of the network — an agency, a business introducer — presented the programme to you, they have
registered your details on the platform. When doing so, they certify that they have informed you of this
transfer. Here is what it involves.
What is processed — your surname, first name, email address, telephone, island or country of
residence and, where applicable, a note on your project; then any options taken and documents sent to
you.
Where the data comes from — the professional who presented the programme to you.
Why, and on what basis — to follow your project and send you documentation; to establish who
introduced you, since this determines their fee. The basis is the company’s legitimate interest in marketing
its programme and fairly remunerating its network.
Who has access — the company, and the professional who registered you (their colleagues see
nothing, except their agency’s manager and, where applicable, its co-manager). Another professional who registers you in turn only learns that you are
already known, never by whom.
How long — three years after the last contact, after which the record is anonymised
automatically.
Objecting — at any time, without giving a reason: write to contact@lesterrassesdepovai.com, or reply
“ne plus m’écrire” (“stop writing to me”) to one of our messages. Your address can then no longer be
registered; we keep only an encrypted fingerprint of it, in order to recognise it.
12Reservation holders and buyers
What is processed — the civil status shown in the reservation agreement (identity, date and place of
birth, nationality, address, occupation, family situation and matrimonial regime), the method of financing
and, where applicable, the loan terms; for an on-screen signature, the time stamp, IP address and proof of the
one-time code.
Why, and on what basis — to draw up the reservation agreement, have it signed, follow its deadlines
(security deposit, financing) and prepare the deed of sale: these are pre-contractual steps taken at your
request, then the performance of the contract.
Who has access — the company, the professional assisting you, and the programme’s notary.
How long — for the duration of the relationship, then for the limitation periods applicable to the
sale. An agreement that was never signed follows the rule for prospects: three years after the last
contact.
Your rights are those in section 9. What bears your signature cannot be erased while these periods run: it is
the evidence of the commitment, for you as for the company.
13Your viewing area
Your contact — a professional from the network, or the developer — may open for you, for a limited time, a
viewing area for the programme: plans, floor areas, prices, availability. To follow up on your project,
what you do there is recorded.
What is recorded — the opening of the area (date, time and IP address of the device when the code is
entered), each of your visits, the plans and documents you open, the price lists you download, and the number
of pages viewed. Nothing is collected outside this area, and no audience-measurement tool or third-party
service is involved.
Why, and on what basis — to know whether the documentation reached you and what caught your
attention, so as to advise you and follow up appropriately. The basis is the company’s legitimate interest in
following the projects entrusted to it.
Who has access — the company, and the professional who opened the access for you.
How long — as for your record: three years after the last contact. IP addresses are masked
after one year.
Cookies — only those in section 10, which are strictly necessary and therefore do not require your
consent.
Your rights are those in section 9: in particular, you may object to this follow-up, without giving a reason,
by writing to contact@lesterrassesdepovai.com.
